These Terms constitute a binding electronic agreement between the User of the “Mara for Files – DocMara” Application and Mara liltaqniyat alhadithah alraqimiah Company, Unified National Number 7053388646, with its registered address at Ad Diriyah 13714, Kingdom of Saudi Arabia.

Please read these Terms before using the Application or purchasing any plan or feature within it. Installing or using the Application, or completing a purchase, constitutes acceptance of these Terms. If the User does not agree to them, the User must stop using the Application and must not complete the purchase.

1. Definitions

The following terms have the meanings set out below:

• Company or Mara: Mara liltaqniyat alhadithah alraqimiah Company.
• Application: The Mara for Files – DocMara application, including its versions and updates.
• User: Any natural or legal person who uses the Application.
• Content: The files, documents, images, text, signatures, and data that the User elects to process.
• Paid Services: Subscriptions, individual purchases, or any paid features offered by the Application.
• Apple: The entity that operates the App Store and payment, purchase, and subscription accounts.
• RevenueCat: The service provider used to validate purchases, manage Entitlements, and provide limited purchase analytics.

2. Eligibility

The User represents that the User has the legal capacity required to accept these Terms.

Purchases must be made by a person having full legal capacity or by, or with the consent of, a legal guardian where the User has limited legal capacity. The age rating displayed in the App Store does not constitute confirmation of contractual capacity.

If the Application is used on behalf of an establishment or other entity, the User represents that the User is authorized to accept these Terms on its behalf, and references to the “User” shall include that entity.

3. Licence and Relationship to Apple’s Terms

The Application is licensed to the User, not sold.

The Company grants the User a limited, non-exclusive, revocable, non-transferable, and non-sublicensable licence to use the Application on Apple devices owned or controlled by the User, for personal use or the establishment’s internal use, and in accordance with Apple’s Usage Rules.

Apple’s Standard Licensed Application End User License Agreement applies to the Application and is supplemented by these Terms. In the event of a conflict:

1. Mandatory provisions of law applicable in the Kingdom shall prevail.
2. These Terms govern the relationship between the User and the Company and the operation of the Application.
3. Apple’s terms govern the App Store transaction, Apple Account, payment, and subscription to the extent administered by Apple.

Apple is not responsible for providing technical support for the Application. The Company remains responsible for the Application and claims relating to it to the extent provided by law and Apple’s agreements.

4. Nature of the Application

The Application provides tools for processing files, images, and documents, which may include:

• Conversion between supported formats.
• Compression, merging, file splitting, and page organization.
• Scanning and text extraction.
• Editing PDF files and adding text, logos, and comments.
• Adding a drawn or typed signature.
• Protecting certain files with a password.
• Creating Quick Response codes.
• Translation, image-background removal, and image resizing.
• Exporting results to a destination selected by the User.

Available tools vary according to the file type, Application version, operating system, device, and plan used.

Core file processing takes place locally on the device. The Application does not provide a DocMara account, cloud-storage service, or backup maintained by the Company.

5. User Files and Rights in Them

All rights in the User’s files and Content remain vested in the User or their lawful owners. The Company claims no ownership of those files or of the results the User creates from them.

The User grants the Application the limited technical permission necessary to process the file locally in accordance with the command selected by the User. This permission does not grant the Company the right to use the file for an independent purpose, view it, use it to train models, or share it.

The User is responsible for ensuring:

• That the User owns the file or has a lawful right to use and process it.
• That the User has obtained the required consents where the file contains data relating to other persons.
• Compliance with duties of confidentiality, data protection, and intellectual property.
• That the result is suitable for the User’s intended purpose.

6. Prohibited Uses

The User must not:

1. Use the Application in an activity that violates laws or public morals.
2. Forge documents, signatures, or instruments, or impersonate another person.
3. Alter or create an official document with the intention of misleading or defrauding.
4. Remove a password or protection from a file the User has no right to open or modify.
5. Copy or process official identification documents in violation of applicable laws or without a legal basis or authority.
6. Infringe the intellectual-property, privacy, or confidentiality rights of others.
7. Introduce malicious software or files designed to harm devices or systems.
8. Circumvent payment systems, Entitlement validation, or usage limits.
9. Resell, rent, sublicense, or make the Application available as a service to others without a written agreement with the Company.
10. Reverse engineer, decompile, or extract source code, except to the extent such restriction is prohibited by law.
11. Use automated or intensive means that affect the stability of the Application or validation systems.
12. Use the Application to process information whose storage or circulation on a personal or unapproved device is prohibited by law.

7. Free Use

The Application may provide free limits, introductory trials, or a specified number of uses for certain tools.

The applicable limits and conditions are displayed within the Application and may vary by tool or version. Free limits do not create a permanent right to the continued availability of a particular tool or limit. They may be modified for future uses without affecting completed purchases or mandatory rights.

8. Subscriptions

The Application may offer a monthly or annual subscription, or another term approved by the Company and Apple.

Before the purchase is completed, the User is shown:

• The plan name.
• The subscription term.
• The final local price.
• The included features.
• Whether a trial period or introductory offer applies.
• Renewal and cancellation terms.

Subscriptions renew automatically at the end of their term until the User cancels renewal through the User’s Apple Account settings. Payment, renewal, billing, and cancellation are administered through Apple.

Final prices, taxes, currencies, and plan availability are displayed in Apple’s interface before confirmation, and the price displayed there is the price governing the transaction.

Future renewal prices may be modified in accordance with Apple’s mechanisms and any notices or consents Apple requires. A price change does not affect the current paid period.

9. “One Feature Use” Purchase

The Application may offer a non-renewing purchase that allows the User to complete one successful qualifying task.

Unless otherwise clearly displayed before purchase:

• This purchase is not a subscription.
• It does not renew automatically.
• It does not unlock all Pro features.
• The credit is consumed after one qualifying task is completed successfully.
• The credit is not intended to be consumed where the task fails before producing the qualifying result.
• An unused credit does not expire merely because time passes, but remains tied to the Apple Account and the availability of the Application and feature.
• The credit cannot be converted into cash or transferred to another Apple Account unless Apple expressly permits it.

10. Cancellation and Refunds

The User may cancel automatic renewal through the Apple Account subscription settings. Access ordinarily continues until the end of the paid period, in accordance with Apple’s terms.

Deleting the Application does not cancel a subscription, and cancelling a subscription does not delete local files.

Apple handles refund and billing requests through its channels. The Company has no access to card details and cannot issue a direct refund outside the mechanisms made available by Apple.

Nothing in these Terms shall be construed as waiving any mandatory right provided by consumer-protection law, the Electronic Commerce Law, or any other applicable law.

11. Signature Tool

The signature tool allows the User to draw a signature, type a name, or insert a visual representation into a file.

This tool is not:

• A signatory identity-verification service.
• An electronic-signature certificate.
• A trust seal or digital certification.
• Notarization or certification by a notary public.
• An electronic-witness service.
• A trusted time stamp.
• A guarantee of the integrity of the signature chain or that the document has not been altered.
• A prior determination of the validity or evidentiary weight of the signature before any authority.

An electronic signature means a system that satisfies legal elements and requirements relating to proof of the signatory’s identity and consent to the transaction. Merely inserting an image of a signature or a typed name into a file does not, by itself, guarantee that all legal or contractual requirements applicable in every case have been satisfied.

The User is responsible for confirming:

• The User’s identity, capacity, and authority to sign.
• The other party’s acceptance of this form of signature.
• That the document satisfies any required formality, notarization, certificate, presence, or consent.
• That the evidence and records needed to prove the signature are retained where necessary.

12. Conversion, Extraction, and Translation

The result of conversion, compression, extraction, or translation may differ from the original file.

Depending on the format and tool, the process may alter or remove elements such as:

• Fonts, formatting, and margins.
• Images and their quality or colors.
• Links and bookmarks.
• Equations, tables, and charts.
• Comments, layers, and interactive fields.
• Metadata.
• Accessibility features.
• Macros or unsupported functions.
• The order of text produced by optical character recognition.
• Meaning or terminology in machine translation.

The resulting translation is not a certified or legal translation, and extracted text is not a certified copy of the document.

The User must retain the original file and review the result in full before signing, printing, sending, or relying on it in a legal, financial, academic, or professional matter.

13. Password Protection of Files

The Application may allow a password or protection to be applied to certain supported formats.

The User is responsible for keeping the password in a secure place. The Company or the Application may be unable to recover it or open the file if it is forgotten.

The Company does not warrant that every format or protection method achieves a particular security level or specific regulatory requirement. The Application must not be regarded as a substitute for approved enterprise document-management or encryption systems where the activity requires them.

14. Quick Response Codes

The Application allows a User to create a Quick Response code from content entered by the User.

The Company does not verify the accuracy or safety of the link or the legality of content placed by the User in the code and does not warrant that the destination is free of phishing or malicious software.

The User is responsible for reviewing the content and link before creating, publishing, or printing the code and for not using it to mislead, defraud, or infringe the rights of others.

15. Saving, Exporting, and Backups

The User selects the destination in which the result is saved, which may be Files, Photos, iCloud, or another application.

The Company does not retain a backup copy of files and does not warrant their recovery if they are deleted or if the device is lost or fails.

Apple, device systems, or services selected by the User may store backup or cloud copies of files or Application data. This is subject to the User’s settings and those services’ policies.

The User is responsible for:

• Retaining an intact original copy.
• Creating appropriate backups.
• Verifying that saving and exporting have completed successfully.
• Securing the device, accounts, and destinations to which files are sent.

16. Third-Party Services

The Application relies for some functions on services or frameworks provided by other parties, including Apple, RevenueCat, operating-system frameworks, and the open-source libraries identified in the Third-Party Notices.

The Application may be affected by the availability, modification, discontinuation, or technical limitations of those services.

When the User chooses to send a result to an external application or service, processing of the file by that entity becomes subject to its terms and policies. The Company is not responsible for the conduct of an independent entity it does not control, without prejudice to any liability that cannot lawfully be excluded.

17. Intellectual Property

The Company or its licensors own all rights relating to the Application, including:

• Code, structure, and design.
• Interfaces, marks, and logos.
• Text and original materials.
• Product names and visual identity.
• Improvements and updates.

Use of the Application grants the User no ownership right in the Application or its marks, except for the limited licence set out in these Terms.

Open-source components remain subject to their licences, and the rights of Apple, RevenueCat, and other parties remain vested in their respective owners.

18. Updates and Service Availability

The Company may issue security, technical, or functional updates, and certain functions may require a current version of the Application or operating system.

The Company may modify, suspend, or discontinue a tool where necessary for security, legal, or technical reasons, or where an external dependency required for its operation is discontinued.

Where a paid subscription is active, the Company will seek not to remove the substance of the paid feature during the current period without a legitimate reason or appropriate remedy, taking into account legal requirements and consumer rights.

The Company does not warrant indefinite support for every device, operating-system version, or file format.

19. Technical Support

Support is provided through:

support@iammara.com

The Company may request reasonable technical information to diagnose an issue.

The User must not send private or confidential documents unless the Company requests a sample and sharing it is necessary, after removing unnecessary data and obtaining any required consents.

An estimated response time is not a guarantee that every issue will be resolved within a specified period, particularly where the issue depends on the operating system, a complex file, or a third-party service.

20. Disclaimer of Warranties

Subject to mandatory rights and warranties that cannot lawfully be excluded, the Application is provided in its available condition.

The Company exercises reasonable care in developing the Application and improving its stability, but does not warrant:

• That the Application is free from every defect or interruption.
• Compatibility with every file, version, or internal structure.
• That the result matches the original in every element.
• That no formatting or metadata will be lost.
• That a document or signature will be accepted by a particular entity.
• That the result is suitable for a specific legal or professional purpose.
• That every feature or external integration will continue unchanged.
• Recovery of files that did not reach the Company’s servers.

The Application is not a legal-archiving, digital-evidence preservation, notarization, certified-translation, enterprise-records management, or cloud-backup service.

21. Limitation of Liability

Without prejudice to any liability that cannot lawfully be excluded or limited, including liability arising from fraud or gross fault, liability resulting from a harmful act, or mandatory consumer rights:

1. The Company’s liability is limited to direct and established damage that was reasonably foreseeable and arose directly from the Company’s breach of its obligations.
2. To the extent permitted by law, the Company is not liable for indirect or consequential loss, loss of profits, opportunities, or reputation, or loss of a file that could have been avoided by retaining the original or a backup copy.
3. The Company is not liable for damage arising from:
   • Use contrary to these Terms.
   • A corrupted or unsupported file.
   • The User’s loss of a password.
   • Failure to review the result.
   • Device, iCloud, or external-application settings.
   • The User’s entry of incorrect data, links, or a signature.
   • An act or interruption attributable to an independent entity outside the Company’s control.
4. To the maximum extent permitted by law, the Company’s total direct contractual liability for the service giving rise to the claim shall not exceed the total amounts paid by the User for that service during the twelve months preceding the event.
5. This Section shall not be construed as excluding liability that the law does not permit to be excluded or as preventing the User from obtaining any mandatory remedy or protection available to the User.

22. User Responsibility for Claims

To the extent permitted by law, the User is responsible for claims and damages arising directly from:

• The User’s intentional use of the Application in unlawful activity.
• The User’s infringement of another party’s intellectual-property, privacy, or confidentiality rights.
• The User’s forgery, impersonation, or use of a signature without authorization.
• The User’s submission of Content the User has no right to process or publish.

This does not apply to damage caused by the Company’s fault or to liability that cannot lawfully be imposed on the User.

23. Suspension and Termination

The Company may suspend access to a Paid Service or refuse to validate an Entitlement where:

• There is no valid purchase receipt.
• The transaction has been cancelled or refunded.
• Circumvention, misuse, or fraudulent activity exists.
• A security risk exists.
• An enforceable legal requirement has been issued.

The User may terminate use by deleting the Application and cancelling the subscription through the User’s Apple Account.

Termination of use does not cancel obligations or rights arising before termination. Provisions concerning ownership, liability, and disputes survive termination by their nature.

24. Amendment of the Terms

These Terms may be updated due to changes in the Application, plans, or legal requirements.

The updated version will be published with a clear effective date, and the Company will use an appropriate means to notify the User of material changes whenever possible.

Changes do not apply retroactively to a completed purchase and will not be used to extinguish a right that arose before they took effect. Continued use of the Application after the updated Terms take effect constitutes acceptance of them for subsequent use, without prejudice to mandatory rights.

25. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

The competent courts in the City of Riyadh shall have jurisdiction over any dispute arising from these Terms or the Application, unless a mandatory law grants the User the right to bring a claim before another authority or court.

The User may contact the Company in an attempt to resolve the dispute amicably. Doing so is not a condition that prevents the User from applying to the competent authorities or exercising legal rights.

26. General Provisions

• These Terms, together with the Privacy Policy and applicable Apple terms, constitute the agreement relating to use of the Application.
• The Company’s failure to exercise a particular right does not constitute a permanent waiver of that right.
• If a provision is held invalid or unenforceable, the effect shall be limited to that provision to the extent necessary, and the remaining provisions shall continue in force.
• The User may not assign rights or obligations without the Company’s consent, except to the extent permitted by law.
• The Company may transfer the agreement to an affiliate or legal successor as part of a restructuring or product transfer, subject to compliance with applicable laws and notice to the User where required.
• Headings are for organization only and do not affect interpretation.

27. Language and Contact

These Terms are available in Arabic and English. In the event of a difference, the Arabic version shall govern, without prejudice to mandatory laws.
