1. تعريف الخدمة وطبيعتها
مرا منصة تقنية معلوماتية تهدف إلى تمكين المستخدمين من عرض وتنظيم وتحليل البيانات الصحية التي يختارون مشاركتها طوعًا، وتقديمها بصورة تحليلية وتفسيرية غير طبية بغرض دعم الفهم العام وتقديم رؤى سياقية ضمن نمط حياة المستخدم اليومي.
مرا—بما في ذلك محتواها ومخرجاتها وواجهاتها وميزاتها—لا تُعد خدمة طبية أو استشارية أو علاجية، ولا يجوز تحت أي ظرف اعتبارها بديلًا عن الرعاية الصحية المهنية أو التشخيص الطبي أو العلاج أو المتابعة الطبية.
كما قد توفر مرا وظائف مرتبطة بالعافية ونمط الحياة مثل: محادثة بالذكاء الاصطناعي ورسائل/تنبيهات استباقية (وقد تشمل إدخالًا صوتيًا اختياريًا يتم تحويله إلى نص)؛ تسجيل الطعام والوجبات؛ تتبع النشاط والتدريب والنوم والترطيب والتعافي والدورة والسجلات الصحية؛ مؤشرات العافية ودرجات/رؤى صحية (للعافية فقط)؛ تحليل ملفات/صور/مستندات (مثل صور الطعام وملفات PDF) باستخدام تحليل الصور والنماذج؛ إشعارات دفعية ومحلية؛ وتكاملات Apple Health وGoogle Health Connect وStrava حيثما يدعمها الإصدار.
2. القبول والالتزام بالشروط
بإنشاء حساب أو تسجيل الدخول أو رفع محتوى أو استخدام تطبيقات مرا أو واجهات الويب/الـAPI أو الإشعارات أو التكاملات، فإنك توافق على هذه الشروط. إذا لم توافق، فعليك التوقف عن استخدام الخدمة وحذف حسابك.
قد تقوم مرا بتحديث هذه الشروط من وقت لآخر. استمرارك في استخدام الخدمة بعد نشر التحديثات يُعد قبولًا ضمنيًا بالشروط المعدلة.
إذا قمت بشراء اشتراك عبر متجر Apple أو Google، فقد تنطبق شروط المتاجر وشروط مزود إدارة الاشتراكات (مثل RevenueCat إن تم استخدامه) على عمليات الشراء والفوترة والإلغاء والاسترداد.
3. نطاق الاستخدام وحدود الاعتماد
يقر المستخدم ويفهم أن جميع المعلومات والمخرجات المقدمة عبر مرا هي لأغراض معلوماتية عامة فقط ولا يجوز تفسيرها أو الاعتماد عليها لاتخاذ قرارات طبية أو تشخيصية أو علاجية.
إلى أقصى حد يسمح به النظام المعمول به، تخلي مرا مسؤوليتها عن أي تبعات ناتجة عن استخدام الخدمة خارج نطاق غرضها المعلن أو عن أي قرار أو إجراء يتخذه المستخدم بالاعتماد على مخرجاتها دون استشارة مختص صحي مؤهل.
4. الأهلية
مرا موجهة للمستخدمين الذين يستوفون الحد الأدنى للعمر ويُسمح لهم قانونيًا باستخدام الخدمة. الحد الأدنى الافتراضي للعمر قد يكون 13+ (مذكور في بعض الإعدادات/التهيئات في بعض التنفيذات). إذا كانت أنظمة بلدك أو سياسات المتاجر تتطلب عمرا أعلى أو موافقة ولي أمر، فيجب الالتزام بذلك. لا تستخدم مرا إذا كان ذلك محظورًا بموجب القوانين أو سياسات المنصات.
5. مسؤولية المستخدم
يتحمل المستخدم المسؤولية الكاملة عن دقة وكمال وصحة أي بيانات يختار إدخالها أو ربطها أو مشاركتها عبر الخدمة، ويقر بأن أي تفسيرات أو رؤى ناتجة تعتمد بطبيعتها على تلك البيانات.
كما يتحمل المستخدم المسؤولية عن التأكد من أن استخدامه للخدمة يتوافق مع هذه الشروط وجميع الأنظمة واللوائح المعمول بها. وتوافق كذلك على: عدم تأخير طلب الرعاية المهنية بسبب مرا؛ التحقق من أي قرار صحي عبر مختص مؤهل.
6. الحسابات والأمان
قد تتطلب بعض ميزات الخدمة إنشاء حساب. أنت مسؤول عن الحفاظ على سرية بيانات الدخول الخاصة بك، وتتحمل كامل المسؤولية عن جميع الأنشطة التي تتم عبر حسابك سواء كانت مصرحًا بها أم لا.
تشمل آليات التنفيذ الحالية Firebase Authentication، وتسجيل الدخول عبر Apple أو Google حيثما يتوفر، وآليات تحقق/استعادة وصول، ووصولًا مبنيًا على الخطط والاستحقاقات.
أنت مسؤول عن حماية بيانات الدخول وأجهزتك وعن جميع أنشطة الحساب.
7. الاشتراكات والفوترة والتجارب
قد تقدم مرا بعض الميزات عبر اشتراكات مدفوعة (مثل خطط بريميوم). إذا كانت الاشتراكات مفعلة، فقد تتم إدارة الفوترة عبر متجر Apple/Google و/أو نظام إدارة اشتراكات (مثل RevenueCat).
مبادئ عامة: الاستحقاقات تعتمد على حالة المتجر ونجاح الدفع؛ الإلغاء والاسترداد والنزاعات تخضع لسياسات المتاجر/المزود؛ التجارب (إن وجدت) قد تكون لمرة واحدة للحساب وقد تنتهي تلقائيًا.
إذا طلبت من Apple استرداد مبلغ عملية شراء، فقد نشارك مع Apple معلومات عن تسليم عملية الشراء واستخدامها لمساعدتها في اتخاذ القرار، كما هو موضح في سياسة الخصوصية. وبإجرائك عمليات شراء داخل التطبيق، فإنك توافق على هذه المشاركة.
8. محتوى المستخدم ومدخلاته
قد ترسل محتوى مثل النصوص أو مدخلات صوتية (تُحوّل إلى نص) أو إدخالات صحية أو صور أو ملفات PDF أو ملفات أخرى حيثما تدعمها الخدمة.
أنت تقر وتضمن أنك: تملك الحقوق والتصاريح اللازمة لإرسال المحتوى؛ لا تنتهك حقوق الآخرين (الملكية الفكرية/الخصوصية)؛ لا ترسل برمجيات خبيثة أو محتوى يهدف للاختراق أو الوصول غير المصرح به.
أنت تظل مالكًا لمحتواك، لكنك تمنح مرا ترخيصًا محدودًا وعالميًا لمعالجة وتخزين ونقل وعرض المحتوى بالقدر اللازم لتشغيل الخدمة وتحسينها.
يجوز لمرا رفض أو إزالة المحتوى الذي يخالف هذه الشروط أو يشكل خطرًا أمنيًا أو تنظيميًا.
9. الاستخدام المقبول
توافق على عدم القيام بـ: انتهاك الأنظمة أو اللوائح أو انتهاك حقوق الملكية الفكرية أو الخصوصية؛ رفع برمجيات خبيثة أو محاولة استغلال ثغرات أو تجاوز حماية الأمان؛ هجمات أو فحص/استطلاع أو scraping أو إساءة استخدام للـAPI بدون إذن؛ التحايل على حدود الخطط أو حدود المعدل أو حدود الأجهزة أو قواعد المرفقات؛ استخدام مخرجات الذكاء الاصطناعي كتعليمات علاجية/تشخيصية دون إشراف مهني؛ انتحال صفة أو تضليل المستخدمين أو الادعاء بالانتماء لمرا.
قد يؤدي سوء الاستخدام إلى تقييد/خفض السرعة أو تعليق أو إنهاء الحساب، وقد يتم الإبلاغ عند الحاجة النظامية.
10. ميزات الذكاء الاصطناعي وحدودها
قد تستخدم مرا مزودين خارجيين للنماذج لتوليد الردود النصية وتحليل الصور/المستندات. تختلف المخرجات حسب المزود والإصدار وطريقة السؤال.
تقر بأن: الذكاء الاصطناعي قد يكون ناقصًا أو خاطئًا أو قديمًا أو مضللًا؛ قد "يهلوس" الذكاء الاصطناعي (معلومات غير دقيقة تُعرض بثقة)؛ السياق محدود بما تشاركه وبما يسمح النظام بحفظه ضمن التاريخ المسموح.
لا تستخدم مخرجات الذكاء الاصطناعي للتشخيص أو العلاج أو قرارات عالية المخاطر دون تأكيد من مختص مؤهل. قد يتم إرسال المدخلات/المرفقات إلى مزودي الذكاء الاصطناعي لمعالجتها عند استخدام هذه الميزات.
11. ميزات الصحة والإحالة لإخلاء المسؤولية الطبي
قد توفر مرا: تتبع العافية (مثل: خطوات، نوم، ماء، أعراض، أدوية، حساسية، حالات، مختبرات، مواعيد)؛ درجات/رؤى عافية وتذكيرات؛ مساعدة في تلخيص/فهم مستندات أو نتائج مختبر.
كل ذلك مخصص للعافية والمعلومات العامة فقط وليس تشخيصًا أو علاجًا. يجب عليك مراجعة إخلاء المسؤولية الطبية المنشور في الموقع/التطبيق، ويُعد مرجعًا أساسيًا للاستخدام الآمن.
12. خدمات الطرف الثالث
قد تعتمد مرا على خدمات طرف ثالث لتقديم وظائف معينة مثل: Firebase Authentication وFirebase Cloud Messaging وRemote Config وApp Check؛ تخزين المرفقات (مثل Google Cloud Storage حسب الإعداد)؛ الفوترة وإدارة الاشتراكات (RevenueCat والمتاجر)؛ تحليل الصور والمستندات والصوت؛ OpenAI أو مزود نماذج مكوّن للخدمة؛ مراقبة أخطاء الخادم عبر Sentry عند تفعيلها؛ وتحليلات اختيارية؛ وتكاملات Apple Health وGoogle Health Connect وStrava حيثما يدعمها الإصدار. لا تتضمن نسخة التطبيق الحالية Firebase Analytics أو Firebase Crashlytics كحزم عميلة.
قد تؤثر سياسات هذه الخدمات أو انقطاعاتها أو تغييراتها على توفر ميزات مرا.
13. الخصوصية وحماية البيانات
تلتزم مرا بتطبيق تدابير تقنية وتنظيمية معقولة لحماية بيانات المستخدم، ومعالجتها وفق سياسة الخصوصية التي تُعد جزءًا لا يتجزأ من هذه الشروط.
لا يتم جمع أو استخدام أو معالجة البيانات إلا بالقدر اللازم لتشغيل الخدمة وتحسينها وبما يسمح به النظام المعمول به. يمكن طلب تصدير أرشيف JSON موثّق أو حذف الحساب من داخل التطبيق؛ يتطلب الحذف عبارة تأكيد ورمزًا من ستة أرقام صالحًا لمدة 15 دقيقة، ثم يبدأ مسار حذف غير متزامن وغير قابل للعكس. راجع: سياسة الخصوصية؛ صفحة حذف البيانات.
14. التعديلات والتطوير
تحتفظ مرا بالحق المطلق في تعديل أو تحديث أو تقييد أو تعليق أو إيقاف أي جزء من الخدمة أو هذه الشروط في أي وقت، دون إشعار مسبق، إذا رأت أن ذلك ضروري للتطوير أو الأمان أو منع الإساءة أو الامتثال التنظيمي.
استمرار استخدامك للخدمة بعد التعديل يُعد قبولًا للشروط المحدثة.
15. توفر الخدمة وإخلاء الضمانات
تُقدم الخدمة على أساس "كما هي" و"حسب التوفر"، دون أي ضمانات صريحة أو ضمنية، بما في ذلك—على سبيل المثال لا الحصر—ضمانات الملاءمة لغرض معين أو التشغيل دون انقطاع أو الأداء الخالي من الأخطاء.
لا تكون مرا مسؤولة عن أي انقطاع أو خلل أو عدم توفر أو فقدان بيانات ناتج عن أسباب تقنية أو تشغيلية أو أسباب خارجية أو تتعلق بأطراف ثالثة. لا يوجد ضمان لمستوى خدمة (SLA) أو نسبة توفر إلا إذا تم نشر ذلك صراحةً من مرا كتابيًا.
16. إخلاءات المسؤولية
لا تضمن مرا دقة أو اكتمال أو ملاءمة المخرجات لأغراض طبية؛ مخرجات الذكاء الاصطناعي وميزات الصحة معلوماتية وقد تكون خاطئة؛ قد تتغير الميزات والحدود والمزودون والنماذج مع الوقت.
17. حدود المسؤولية
إلى أقصى حد يسمح به النظام المعمول به، تخلي مرا مسؤوليتها عن أي مطالبات أو أضرار أو خسائر—سواء مباشرة أو غير مباشرة أو عرضية أو تبعية أو خاصة أو عقابية—تنشأ عن أو تتعلق بـ: وصولك أو استخدامك لمرا، اعتمادك على المخرجات، انقطاع الخدمة أو تعطلها، فقدان البيانات، انقطاعات أو تغييرات مزودي الطرف الثالث.
وحيث لا يمكن إخلاء المسؤولية بالكامل، تُقيد بالحد الأدنى المسموح به نظامًا. العلاج الأساسي لك هو التوقف عن استخدام الخدمة وحذف حسابك.
18. التعويض
إلى الحد الذي يسمح به النظام، توافق على تعويض مرا والشركات التابعة لها ومزوديها وحمايتهم من أي مطالبات أو خسائر أو مسؤوليات أو أضرار أو مصروفات (بما فيها أتعاب قانونية معقولة) ناشئة عن: إساءة استخدامك للخدمة، مخالفتك لهذه الشروط، انتهاكك لحقوق طرف ثالث، إرسال محتوى غير قانوني أو ضار.
19. التعليق أو الإنهاء
يمكنك التوقف عن استخدام مرا وحذف حسابك في أي وقت.
ويجوز لمرا، حسب تقديرها وضمن ما يسمح به النظام، تعليق أو إنهاء وصولك كليًا أو جزئيًا عند: إساءة الاستخدام، مخالفة الشروط، نشاط غير قانوني، مخاطر أمنية، عدم الدفع أو فقدان الاستحقاقات (بسبب المتجر)، متطلبات مزودي الطرف الثالث أو المنصات.
عند الإنهاء قد يتوقف الوصول فورًا. وقد يتم الاحتفاظ ببعض البيانات أو إخفاء هويتها أو تقييدها وفق سياسة الخصوصية/حذف البيانات. لا يوجد ضمان لإعادة التفعيل.
20. الملكية الفكرية
جميع حقوق الملكية الفكرية المتعلقة بمرا—بما في ذلك البرمجيات والتصاميم والنصوص والعلامات والنماذج التحليلية—مملوكة لمرا أو مرخصة لها. ويُحظر أي استخدام أو نسخ أو توزيع دون إذن كتابي مسبق.
تظل مكتبات وخدمات الطرف الثالث خاضعة لتراخيصها الخاصة. أنت تحتفظ بملكية محتواك، مع مراعاة الترخيص المحدود الذي تمنحه لمرا لتشغيل الخدمة.
21. القانون الحاكم وتسوية النزاعات
تخضع هذه الشروط وتُفسر وفق الأنظمة واللوائح المعمول بها، دون الإخلال بأي حقوق تنظيمية أو تعاقدية أخرى.

Please read these Terms and Conditions carefully before using any of Mara's services. By accessing or using the application, website, or any related services, you expressly acknowledge and fully and unconditionally agree to be bound by these Terms.
1. Service Definition and Nature
Mara is an informational technology platform designed to enable users to view, organize, and analyze health-related data that they voluntarily choose to share, and to present such data in an analytical and interpretive, non-medical manner, with the purpose of supporting general understanding and providing contextual insights within the user's daily lifestyle.
Mara—including all of its content, outputs, interfaces, and features—does not constitute a medical, advisory, or therapeutic service, and shall not under any circumstances be considered a substitute for professional healthcare, medical diagnosis, treatment, or follow-up.
In addition, Mara may provide wellness and lifestyle guidance through: AI chat and proactive prompts (including optional voice input via speech-to-text); food and meal logging; activity, training, sleep, hydration, recovery, cycle, and health-record tools; wellness insights/scores (wellness-only); document/image analysis (including food photos and PDFs) using image analysis and models; push and local reminders; and Apple Health, Google Health Connect, and Strava integrations where supported by the version.
2. Acceptance of Terms
By creating an account, signing in, uploading content, using Mara's mobile apps, web/API endpoints, notifications, or integrations, you agree to these Terms. If you do not agree, stop using the service and delete your account.
Mara may update these Terms from time to time. Continued use after updates constitutes acceptance of the updated Terms.
If you purchase subscriptions through Apple App Store or Google Play, then store terms and RevenueCat terms (if used for subscription management) may also apply to your purchases and billing.
3. Scope of Use and Reliance Limitations
The user acknowledges and understands that all information and outputs provided through Mara are for general informational purposes only and must not be interpreted or relied upon for medical, diagnostic, or treatment-related decisions.
To the fullest extent permitted by applicable law, Mara disclaims all liability arising from any use of the service beyond its stated purpose or from any action or decision taken by the user based on its outputs without consultation with a qualified healthcare professional.
4. Eligibility
Mara is intended for users who meet the minimum age requirements and are legally permitted to use the service. Default minimum age may be 13+ (as referenced in configuration in some implementations). If your locale, laws, or app store rules require a higher age or guardian consent, you must comply accordingly. Do not use Mara where prohibited by applicable law or platform rules.
5. User Responsibility
The user bears full responsibility for the accuracy, completeness, and validity of any data they choose to input, connect, or share through the service and acknowledges that any resulting interpretations inherently depend on such data.
The user is solely responsible for ensuring that their use of the service complies with these Terms and all applicable laws and regulations. You also agree: Not to delay seeking professional care because of Mara; To verify any health-related decisions with a qualified professional.
6. Accounts and Security
Certain features may require a user account. You are responsible for maintaining the confidentiality of your login credentials and accept full responsibility for all activities conducted through your account, whether authorized or unauthorized.
Current implementation includes Firebase Authentication, with Apple or Google sign-in where available, verification/recovery flows, and access based on plans and entitlements.
You are responsible for protecting your credentials and devices and for all activity under your account.
7. Subscriptions, Billing, and Trials
Certain features may be offered via paid subscriptions (e.g., Premium plans). If enabled, billing may be managed through the Apple App Store / Google Play and/or subscription management services (e.g., RevenueCat).
General principles: Subscription access and entitlements depend on store status and successful billing; Cancellation, refunds, and billing disputes are governed by store/provider policies; Trials (if offered) may be limited to one-time use per account and may expire automatically.
If you ask Apple for a refund of a purchase, we may share information with Apple about the purchase's delivery and use to help it decide, as described in the Privacy Policy. By making in-app purchases, you consent to this sharing.
8. User Content and Inputs
You may submit content such as text, voice input (converted to text), health entries, images, PDFs, and other files where supported.
You represent and warrant that: You have the rights and permissions to submit your content; Your content is lawful, non-infringing, and does not violate privacy rights; Your content does not contain malware, harmful code, or unauthorized access attempts.
You remain the owner of your content, but you grant Mara a limited, worldwide license to process, store, transmit, and display such content only to the extent necessary to operate and improve the service.
Mara may reject or remove content that violates these Terms or presents security or compliance risk.
9. Acceptable Use
You agree NOT to: Violate laws or regulations, or infringe intellectual property or privacy rights; Upload malware, attempt to exploit vulnerabilities, or bypass security protections; Scrape, probe, attack, or abuse the service or APIs without permission; Circumvent plan limits, rate limits, device limits, or attachment rules; Misuse AI outputs as clinical directives without professional oversight; Impersonate others or misrepresent affiliation with Mara.
Abuse may result in throttling, suspension, termination, or reporting where required by law.
10. AI Features and Limitations
Mara may use third-party model providers for AI text responses and image/document analysis. Outputs can vary by provider, version, and prompt.
You acknowledge: AI may be incomplete, incorrect, outdated, or misleading; AI may "hallucinate" (generate confident but inaccurate information); Context is limited to what you share and what the system retains in allowed history.
Do not use AI outputs for medical diagnosis/treatment or other high-risk decisions without professional confirmation. Where supported, attachments and user inputs may be transmitted to AI providers for processing.
11. Health Features and Medical Disclaimer Reference
Mara may provide: Wellness tracking (e.g., steps, sleep, hydration, symptoms, medications, allergies, conditions, labs, appointments); Wellness insights/scores and reminders; Document or lab summary assistance.
All such functionality is for wellness and informational purposes only and is not diagnostic or therapeutic. You must review and follow the Medical Disclaimer published on the website/app, which forms an integral reference for safe use.
12. Third-Party Services
Mara may rely on third-party services to deliver functionality, such as: Firebase Authentication, Cloud Messaging, Remote Config, and App Check; storage providers for attachments (such as Google Cloud Storage when configured); RevenueCat and app stores for subscription entitlements; image/document and speech processing; OpenAI or another configured model provider; server error monitoring through Sentry when enabled; optional analytics; and Apple Health, Google Health Connect, or Strava integrations where supported. The current client does not include Firebase Analytics or Firebase Crashlytics packages.
Their availability and terms may affect service features. Provider outages, policy changes, or enforcement actions can impact Mara functionality.
13. Privacy and Data Protection
Mara is committed to implementing reasonable technical and organizational measures to protect user data and to processing such data in accordance with its Privacy Policy, which forms an integral part of these Terms.
No data is collected, used, or processed except to the extent necessary for operating and improving the service and as permitted under applicable laws and regulations.
For export and deletion, the app can create a verified JSON archive or start account deletion after a confirmation phrase and a six-digit code valid for 15 minutes. Deletion then runs asynchronously and cannot be undone. Store purchase records and subscription cancellation remain governed by Apple/Google; manage an App Store subscription in Apple subscription settings and a Play subscription in Google Play.
14. Modifications and Development
Mara reserves the absolute right to modify, update, suspend, limit, or discontinue any part of the service or these Terms at any time, without prior notice, whenever it deems such action necessary for service development, security, abuse prevention, or regulatory compliance.
Continued use of the service following any modification constitutes acceptance of the updated Terms.
15. Service Availability and Warranty Disclaimer
The service is provided on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to warranties of fitness for a particular purpose, uninterrupted operation, or error-free performance.
Mara shall not be liable for any interruption, malfunction, unavailability, or loss of data resulting from technical, operational, third-party, or external causes. No SLA or uptime guarantee is provided unless explicitly published by Mara in writing.
16. Disclaimers
Mara does not guarantee accuracy, completeness, or suitability of outputs for medical purposes; AI and health outputs are informational and may be wrong; Mara does not guarantee that features will remain unchanged; limits/models/providers may change.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Mara disclaims all liability for any claims, damages, losses, or injuries—whether direct, indirect, incidental, consequential, special, or punitive—arising out of or related to: your access to or use of Mara, your reliance on any outputs, service interruptions, loss of data, third-party provider outages or changes.
Where liability cannot be fully disclaimed, it is limited to the minimum extent permitted by law. Your primary remedy is to stop using the service and delete your account.
18. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold Mara, its affiliates, and its providers harmless from claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from: your misuse of the service, your violation of these Terms, your infringement of third-party rights, your unlawful content submissions.
19. Suspension or Termination
You may stop using Mara and delete your account at any time.
Mara may, at its sole discretion and to the extent permitted by law, suspend or terminate your access in whole or in part in the event of: misuse, violation of these Terms, illegal activity, security threats, non-payment or store-managed entitlement loss, requirements imposed by third-party providers/platforms.
Upon termination, access may stop immediately. Some data may be retained, anonymized, or restricted as described in the Privacy Policy/Data Deletion pages. Reinstatement is not guaranteed.
20. Intellectual Property
All intellectual property rights related to Mara, including but not limited to software, designs, texts, trademarks, and analytical models, are owned by or licensed to Mara. Any use, reproduction, or distribution without prior written authorization is strictly prohibited.
Third-party libraries, services, and models remain under their respective licenses. You retain ownership of your submitted content, subject to the limited license granted to Mara to operate the service.
21. Governing Law and Disputes
These Terms shall be governed by and interpreted in accordance with applicable laws and regulations, without prejudice to any other regulatory or contractual rights.

By using Mara's services, you acknowledge that you have read and fully understood these Terms, agree to be bound by them, recognize the nature and limitations of the service, and accept full responsibility for your use thereof.
